Supreme Court clears path for stalled Sushant Aquapolis, 1,600 buyers get relief
The Supreme Court has allowed One City Infrastructure to proceed with the Sushant Aquapolis resolution plan without claiming land title. The Ghaziabad Development Authority has now approved the revised building plan, offering relief to 1,600 homebuyers.
The Supreme Court has cleared the way for implementation of the resolution plan for the stalled Sushant Aquapolis township in Ghaziabad, allowing corporate debtor Ansal Urban Condominium to develop a 24-metre-wide pathway without asserting any title over the land. The order offers relief to about 1,600 homebuyers of the project, which is under insolvency proceedings.
The 26-acre township near Crossings Republik was launched in 2007-2008 by Ansal API. Between 2014 and 2017, the developer submitted layout drafts and revised proposals to the Ghaziabad Development Authority (GDA) under the Uttar Pradesh Integrated Township Policy. However, financial constraints, mismanagement and disputes with creditors led to lapses in building layout approvals over the years. In 2019, the company was declared insolvent and the project went to the National Company Law Appellate Tribunal (NCLAT), which tasked One City Infrastructure Pvt Ltd with completing it.
The resolution plan submitted by One City was approved under Section 31 of the Insolvency and Bankruptcy Code, but construction could not resume as GDA withheld renewal of the development licence and sanction of the revised building plan. The development authority held that the original allottee, Ansal API, could only apply under the rules. One City then moved the Supreme Court, which ordered GDA and the Uttar Pradesh government to approve the layout plan.
On 30 July, the Supreme Court directed the state government and GDA to resolve the issues within two weeks and ordered a site inspection. GDA subsequently told the court it would sanction the building plan after an online application, keeping homebuyers’ interests in mind. On 21 Aug, the GDA board approved the proposal to pass the revised building plan. In its 31 Aug order, the bench directed the developer to undertake all internal and external development work up to the approach road, including the pathway.
GDA vice chairperson Nand Kishore Kalal said the revised plan has been approved by the GDA Board under the Uttar Pradesh Model Building Construction and Development Bylaws, 2025. “The revised building plan will be processed on FastPass portal within a fortnight in the interests of the homebuyers,” he said.
