Karnataka RERA orders Eco Life Developers to register allottees association within 60 days

The Karnataka Real Estate Regulatory Authority (K-RERA) has directed Eco Life Developers to constitute and register an association of allottees before the competent authority within 60 days, in accordance with applicable law. The order was issued after hearing a complaint filed by Swetha Rangaswamy, who purchased a flat from the developer.

Rangaswamy lodged a complaint stating that she and other allottees were waiting for the developer to facilitate the formation and registration of an association of allottees and to transfer common areas and corresponding rights and title to that association, as required under the Real Estate (Regulation and Development) Act, 2016. Despite the completion of the apartments and handover of possession, the developer allegedly failed to complete these statutory obligations.

The complainant alleged that when allottees requested proof of the association's registration, the developer claimed an association had already been registered under the Karnataka Apartment Ownership Act, 1972 but failed to furnish a Certificate of Registration from the competent authority to support that claim. K-RERA found that the developer needed to take necessary steps to complete any outstanding statutory formalities.

In its order, K-RERA directed Eco Life Developers to fulfil its obligations under Sections 11(4)(f) and 17 of the Act, 2016, and execute the requisite conveyance or other transfer documents relating to common areas and undivided proportionate title in favour of the association of allottees or the competent authority, as applicable.
